MN Court of Appeals Decision
MNDDA Members,
Today we received notice of the Court of Appeals Opinion from our hearing on June 20th, 2024. It was not the news we were expecting, but we have some options moving forward and we would like your input.
The Opinion is attached to this email. To keep it short, they reversed the injunction that we had in place. They did not reverse it based on the merits of the case, but rather on our ‘alleged temporary loss of household income constituting an irreparable harm.’
One consideration we would like to explore is based on our members’ input regarding loss of income and how the new offsets will impact each of you. The PERA offset calculator is attached to this email. We are asking each of you to take a minute to calculate your offsets and report those figures back to us.
One aspect of the calculator addresses this question: “Approximately how much does someone currently earn in the position you had at the time of your disability?” In order to help find this information, here is a link to the contracts that are represented by the Law Enforcement Labor Services labor union: www.lels.org/current-contracts/
Also attached to this email is the most recent MPD contract settlement wage sheet. If you would like assistance in locating the current labor contract for your former agency, please reach out. We would be happy to help!
Over the course of the next couple of weeks, we have meetings set with our legal team and will hear their advice on next steps. In the meantime, we would appreciate your help collecting this wage data and offering your input as this will directly impact our decision making. We hope to host a membership-wide meeting sometime in the next few weeks. More information to come.
On behalf of the MNDDA board, please know that our fight is not over yet. We want to be strategic in our next steps, but we are still optimistic! We are not giving up.
